Terms of Service
DEFRAGGER.IO ("the game") is an independent browser game operated by Kyle Bigart ("we"). By playing, you agree to these terms. They're short on purpose.
1. The game
The game is free to play in your browser. We may change, pause or discontinue any part of it at any time, including balance changes that affect your progress. We'll try not to be surprising about it.
2. Accounts
- You need an account (via Google sign-in) to progress past the first prestige. Keep one account per person.
- You're responsible for what happens under your account. Don't share it.
- You must be 13 or older to create an account.
- We can suspend or delete accounts that break these terms, abuse the service, or sit unused for a very long time. We'll delete your account on request — see the Privacy Policy.
3. Fair play
Don't attack the service, scrape it, hammer the API, tamper with saves or requests, or use automation that gives you an advantage over other players if and when competitive features exist. Modding your own local save for fun is your business; pushing a tampered save into a shared feature isn't.
4. Purchases
When paid options exist (such as a one-time "Pro" upgrade that removes advertising), the price and what it includes will be shown before you pay. Purchases are handled by a third-party payment processor under their terms. Digital purchases are generally non-refundable once delivered, except where the law where you live says otherwise. Virtual items, currency and progress in the game have no real-world value and can't be exchanged for money.
5. Advertising
The free version may show advertisements. Ad providers will be named in the Privacy Policy before ads appear.
6. Content and ownership
The game — its code, art, names, sounds and design — belongs to us and is protected by copyright. Playing it doesn't transfer any of that to you. You may share screenshots and videos of your play freely, including in monetised videos or streams.
7. No warranty
The game is provided "as is" and "as available", without warranties of any kind. It's an indie project; it will have bugs, and saves can occasionally be lost despite our best efforts.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of the game, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim (which for most players is zero).
9. Governing law
These terms are governed by the laws of the United States. If any part of them is found unenforceable, the rest still applies.
10. Changes
We may update these terms. The date at the top changes when we do, and the game will point out significant changes. Continuing to play after that means you accept them.
